Effective date: September 25, 2026
These Terms of Use ("Terms") govern access to ikawn.com and the websites, virtual try-on tools, retail kiosks, brand activations, ecommerce integrations, demonstrations and related services made available by iKawn Inc. under the iKawn and iKawn Mirror names (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Important try-on terms
- Demo, trial, free and otherwise unpaid try-ons may be recorded. Those recordings may be used for marketing, internal staff training, product demonstrations, service evaluation and, where disclosed and legally permitted, improvement of relevant models or workflows.
- Paid try-ons are privacy protected. Paid Try-On Content is not used for AI or model training, marketing, promotions, internal demonstrations or staff training.
- Paid try-on media is not kept indefinitely. It is automatically deleted after the configured retention period disclosed in the relevant customer agreement, order form, deployment notice or product interface.
- Earlier deletion can be requested. Write to support@ikawn.com with enough information to identify the session.
1. Who we are
"iKawn", "iKawn Mirror", "we", "our" and "us" mean iKawn Inc., with its registered office at 8 The Green, Suite B, Dover, Kent, Delaware 19901, United States. "You" means the individual or organisation accessing or using the Services.
2. Eligibility and authority
You must be legally capable of agreeing to these Terms. If you use the Services for an employer, brand, retailer or other organisation, you represent that you have authority to bind that organisation. A minor may use a try-on only with the involvement and permission of a parent or legal guardian and subject to applicable law and the deploying organisation's notice.
3. The Services
The Services may allow you to submit or capture photos, video, camera frames, garment selections, prompts or other materials ("Input") and receive generated images, video, recommendations, session results or other material ("Output"). Input and Output together are "Content".
AI-generated Output may be incomplete, inaccurate, visually inconsistent or similar to output produced for another user. Virtual try-on is a visualisation aid, not a guarantee of physical fit, sizing, drape, inventory, availability or purchase outcome. You are responsible for reviewing Output before relying on or publishing it.
4. Accounts and access
Some Services may require an account, access code or customer deployment. You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorised use. You are responsible for activity conducted through your account or credentials.
5. Your Content and permissions
As between you and iKawn, you retain the rights you hold in your Input. Subject to these Terms, your contract and third-party rights, you may use your Output for lawful purposes. You grant iKawn and its service providers the limited rights necessary to host, process, transmit and generate Content to operate, secure and support the Services.
You represent that you have all rights, permissions and consents needed to submit Input and allow the processing described in these Terms and the Privacy Policy. Do not upload another person's image, confidential material, copyrighted product imagery or other protected content unless you are authorised to do so.
6. Demo and unpaid try-on recordings
A "Demo or Unpaid Try-On" is a trial, evaluation, sample, free experience or any other try-on not delivered under an active paid iKawn customer deployment. A Demo or Unpaid Try-On may be recorded. Recordings may include camera or uploaded media, generated Output, selections, screen or session activity, and associated technical metadata.
By beginning or continuing a Demo or Unpaid Try-On after receiving access to these Terms or an applicable notice, you permit iKawn to record and use that Content to provide and evaluate the Services, investigate technical issues, train staff, create internal or customer demonstrations, develop marketing or promotional material, and improve relevant models or workflows where that use is clearly disclosed and legally permitted. This permission is non-exclusive, worldwide and royalty-free, and includes the right to edit or format the recording for those purposes. We may use service providers solely to carry out these activities for us.
Where applicable law requires a separate consent for a specific recording or promotional use, we will seek it. If you do not agree to these uses, do not begin or continue a Demo or Unpaid Try-On.
7. Paid try-on privacy
A "Paid Try-On" is a session delivered under an active paid iKawn customer subscription, order form or deployment agreement. It is treated as paid even if the shopper does not personally pay.
Paid Try-On Content is privacy protected and processed only to provide, secure, troubleshoot and support the paid service, comply with law, or follow the customer's documented instructions. iKawn does not use or permit Paid Try-On Content to be used for AI or model training, marketing, promotional material, internal demonstrations or staff training.
Raw Paid Try-On Content is automatically deleted after the retention period configured for the paid service and communicated in the applicable customer agreement, order form, deployment notice or product interface. A user may request earlier deletion by emailing support@ikawn.com. We may require verification and information sufficient to locate the session. Lawful security, billing, fraud-prevention or dispute records may be retained for longer where necessary.
8. Acceptable use
You must not use the Services to:
- violate law, third-party rights, privacy, publicity, intellectual-property or contractual obligations;
- create deceptive impersonation, non-consensual intimate imagery, harassment, exploitation or unlawful discriminatory content;
- submit images of another person without the permissions required for the intended use;
- probe, disrupt, overload, bypass or compromise security, access controls, rate limits or infrastructure;
- reverse engineer or extract source code, models, weights or non-public systems except where law expressly permits it;
- use automated means to scrape or access the Services without written permission; or
- misrepresent Output as authentic where law, platform rules or context require disclosure that it is AI-generated or altered.
9. Paid services
Pricing, usage allowances, retention settings, service levels, cancellation rights and payment terms for paid Services are set out in the applicable order form, subscription, invoice or customer agreement. If those documents conflict with these Terms, the signed or expressly accepted customer-specific document controls for the conflicting subject.
10. iKawn intellectual property
The Services, software, interfaces, designs, documentation, trademarks, logos and other materials supplied by iKawn, excluding your Content and third-party material, are owned by or licensed to iKawn and protected by applicable law. Except for the limited right to use the Services under these Terms, no rights are transferred to you.
11. Feedback
If you voluntarily provide feedback or suggestions, you permit us to use them without restriction or compensation, provided we do not identify you publicly without permission.
12. Third-party services
The Services may rely on or link to third-party platforms, commerce systems, cloud infrastructure, payment providers or AI processors. Third-party services may have separate terms and privacy notices. iKawn is not responsible for third-party services it does not control.
13. Privacy
Our Privacy Policy explains how Personal Data is handled, including the different treatment of Demo or Unpaid Try-On Content and Paid Try-On Content.
14. Suspension and termination
We may limit or suspend access where reasonably necessary to address a Terms violation, non-payment, security risk, unlawful use, technical harm or legal requirement. You may stop using the Services at any time. Provisions that by their nature should survive termination—including ownership, licences already exercised, privacy, disclaimers, liability and dispute terms—will survive.
15. Service changes
We may modify, discontinue or update features. We will provide any notice required by law or a customer agreement. We may also update these Terms; the revised version will state its effective date. Continued use after the effective date constitutes acceptance where permitted by law.
16. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee uninterrupted availability, error-free operation, unique Output, exact visual or physical fit, commercial results, or suitability for a particular purpose. Nothing in these Terms excludes warranties or statutory rights that cannot lawfully be excluded.
17. Limitation of liability
To the maximum extent permitted by law, iKawn will not be liable for indirect, incidental, special, exemplary or consequential loss, or loss of profits, revenue, goodwill or data arising from use of the Services. For a paid Service, iKawn's aggregate liability relating to that Service will not exceed the fees paid to iKawn for that Service during the three months preceding the event giving rise to the claim, unless a customer agreement states otherwise or applicable law prohibits that limitation.
18. Indemnity
To the extent permitted by law, you agree to indemnify iKawn against third-party claims, losses and reasonable costs arising from your unlawful use of the Services, your Content, your breach of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim was caused by iKawn's own breach or unlawful conduct.
19. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles and without limiting mandatory rights available under applicable law. State and federal courts with competent jurisdiction in Delaware will have jurisdiction unless a customer agreement or mandatory law provides otherwise.
